Braes Lodge Booking Conditions and Terms of Letting

Within these Booking Conditions and Terms of Letting, you and your means the person signing the conditions as party leader. We, us and our means Braes Enterprises Ltd at 6 Atholl Cresent, Perth, PH1 5JN

Booking Contract

You agree to enter into a contract under the following Terms and Conditions.

When you submit a booking via our online reservation system you will receive an automatically generated booking summary via email to the address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a Braes Lodge Confirmation of Reservation sent to you via email.

Bookings taken within 4 weeks of arrival at the property must be paid in full at the time of booking.

We reserve the right to refuse any booking. You must be aged 21 years or over when the booking is made.

Your Responsibilities

You must keep the property and all furniture, fittings, facilities, equipment and grounds in the same state of repair and condition as at the commencement of the holiday and in the same state of general order in which they were found. You will be responsible for payment of any breakages caused by you. The person signing the contract is responsible for the correct and decent behaviour of the party. If you or a member of your party abuse the property or display dangerous, offensive or rude behaviour to representatives or third parties we reserve the right to terminate the letting.

You must not exceed the maximum number of people stated in the property details.

You must not exceed the number of people booked for the letting.

Visitors - we are sorry but Braes Lodge is for patrons only and all facilities are for your use only unless otherwise agreed with us first.

We or our representatives have a right to access the property at any reasonable time during your stay to carry out essential maintenance.

In the event of you breaching the responsibilities set out above, we reserve the right to access the property and the contract will be terminated without refund or compensation.

Arrival and Departure

You must arrive and depart within the check in and check out times stipulated unless arrangements have been made in advance - Arrival after 4 p.m. Departure before 10 a.m.

Breakages and Insurance

Minor breakages must be replaced with similar items. You must report any breakage or damage to us promptly.

Personal possessions are not covered by our insurance. Any valuables left at the property are left at your own risk. It is essential and your responsibility to ensure all doors and windows are closed when leaving the property. You agree for us to deduct from your credit card for any damage or extra cleaning bills. We advise that you take out adequate travel insurance (including liability for accidental damage to the property).

Liability

We cannot accept liability for any loss, damage or injury howsoever caused to you or the property. The hot tub may not be up to temperature on arrival due to the cleaning process.

We cannot be held responsible for noise or disturbance originating beyond the boundaries of our site. We cannot accept any liability for compensation where performance to contractual obligations is prevented or affected outside our control including weather conditions, acts of God, explosions, tempest, fire or accident, war or threat of war changing restrictions and regulations of any kind on the part of the Government or local authorities, strike or other industrial action or dispute.

We cannot accept responsibility for the failure of public services such as water, electricity, sewerage systems, breakdown of domestic equipment and breakdown of mechanical equipment, but will endeavour to arrange prompt repairs.

Complaints

In the event that a complaint arises whilst you are on holiday you should contact us or our representatives promptly to allow us an opportunity to rectify the matter.

If the problem is not solved to your reasonable satisfaction during your stay, you must make your comments to us in writing within 7 days of leaving the property.

We cannot accept complaints unless this procedure is followed. Complaints received after this time will not be accepted. If we have not had prior notification of your complaint and if you vacate the property before the departure date without notifying us you will forfeit your right to a refund.

Alterations and Cancellations by You

If you request any changes to your booking we will endeavour to comply, but cannot guarantee this. Cancellation by you of your booking must be in writing. The effective date of cancellation must be given on your written notification. Our charges for cancellation are detailed below - number of days before rental start date that notification is received and cancellation charge (percentage of total cost):

0 to 27 days - 100%
27 days or more - 50%
Any deposit paid is non refundable

If you cancel at any time we will endeavour to find a replacement client. If a replacement is found, we will then refund all monies paid by you for the property rental, less any difference between the cost for your holiday, the deposit and the price paid by the replacement client.

We strongly advise you to take out cancellation insurance.

Alterations and Cancellations by Us

In the interest of continual improvement we reserve the right to make minor modifications to any amenities and facilities without any prior notice.

In the unlikely event that the property is not available on the date you booked (owing to damage) we will refund all monies paid by you to us. We will try to help find alternative accommodation of a similar standard and location.

Pets

No pets are allowed on site unless agreed with us in writing prior to arrival.

Children

No children are allowed to stay on site unless agreed with us in writing prior to arrival.

Smoking

Braes Lodge is a No Smoking building. Please note that we cannot change over to the next client if you have been smoking because of the smell and a specialist cleaner will be called in. All costs incurred would be charged to the party leader.

Web Accuracy

The contents of our web pages have been prepared in good faith.

Privacy Policy

We guarantee that your personal information provided to us is kept confidential. We may use your data in the future to update you on our product. Please let us know if you want your personal details to be removed from our files after your stay.

Law

These terms and conditions and the contract to which they apply are governed by Scottish Law.

Morgan Self Drive Hire Terms & Conditions

Within these Terms & Conditions, you and your means the Hirer or any additional driver signing the Morgan Self Drive Hire Agreement. We, us and our means Braes Enterprises Ltd (Registration Number SC471808) at 6 Atholl Cresent, Perth, PH1 5JN

General Conditions

The Morgan is covered for use throughout the UK mainland and is offered with unlimited mileage and breakdown cover.

Full payment for the Morgan Self Drive Hire will be required 30 days prior to arrival at Braes Lodge via credit card.

The Morgan is supplied with a full tank of fuel and should be returned to Braes Lodge with a full tank of fuel at the end of the hire period. The Hirer may purchase a full tank of fuel at the start of the hire; however, no refund of monies for unused fuel will be given.

The Morgan will be inspected and its condition will be agreed prior to and at completion of the hire period by a representative of Braes Enterprises Ltd and the Hirer.

The vehicle must only be used on classified roads. The vehicle shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature or for the carriage of goods or passengers for hire or reward. The vehicle shall not be used for racing, pace making or testing the vehicle's reliability and speed. The Hirer or any additional driver must not use the vehicle whilst under the influence of alcohol or drugs.

The Morgan is strictly a no smoking vehicle.

Insurance and Other Charges

Fully comprehensive insurance cover is included in the Morgan Self Drive Hire charge. However, the Hirer is responsible for the first £750.00 of any loss, damage or theft.

The Hirer is also responsible for the full cost of puncture repair, damage to wheels, spokes, tyres, hood and windscreen and any loss or damage of keys, tonneau cover, side panels, side panel carrier or accessories.

The Hirer will be charged for the full costs of recovery and repair of the Morgan due to the use of incorrect fuel.

Security Bond / Insurance Excess

In addition to the Morgan Self Drive Hire charges Braes Lodge will require a combined Security Bond/Insurance Excess of £750 for each hire guaranteed via a charge to the Hirer's credit card three days before hire commences. The Security Bond/Insurance Excess is to cover any damage, loss or theft to the vehicle not covered by the insurance and to cover speeding fines, parking ticket or refuelling charges etc.

Provided the vehicle is returned at the end of the hire in the same condition as at the start of the hire a full refund of the Security Bond/Insurance Excess will be made. If any further charges arise after the Security Bond/Insurance Excess has been returned which relate to the hire of the vehicle, the Hirer will be held responsible for reimbursement to Braes Lodge within 7 days of notification.

Hirer and Driver Licence Requirements

The Hirer and any additional driver must agree to and comply with the following hire conditions

1) Must be between 25 and 70 years of age inclusive and have held a full UK/EU driving licence for a minimum of three (3) years.
2) Must not have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or have had their driving licence endorsed or suspended or more than six (6) penalty points imposed.
3) Must not, whilst driving, have been involved in more than one accident during the past three (3) years.
4) Must not have had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or have had their insurance cover cancelled by any Motor Insurer.
5) Must not be engaged wholly or partly in professional entertainment or be professional sports persons.
6) Must not be jockeys or persons connected with racing, gaming industry or press of any sort.
7) Must not be undergraduates and/or students under 25 years of age.
8) Must not be Foreign Service Personnel other than persons holding a full UK/EU licence for three years or more.

If the Hirer or any additional driver is not able to comply with conditions 2-4 above then please call or email Braes Lodge before arrival and we can refer this to our insurers for possible acceptance - though this may incur additional surcharges.

Additional Drivers

In addition to the Hirer, up to 3 additional drivers can be insured to drive the vehicle, provided they meet the Hirer and Driver Licence requirements stated above. Additional Driver Insurance charges are £10 per hire for each additional driver.

Rental Agreement - Hirer and Driver Identification

The Hirer and any additional drivers must complete and sign the Braes Lodge Morgan Self Drive Hire Agreement form and each present ID as follows

Driving Licence (UK photo licences must be presented along with a DVLA Licence Check Code generated within the last 21 days – alternatively the Licence Check Code can be generated at time of hire if the National Insurance Number of each driver is provided)
AND
TWO additional forms of ID with addresses matching that of the Driving Licence (i.e. Utility Bills, Credit Card or Bank Statements (no more than 60 days old)) at time of hire for verification of identity, permanent address and driving penalties or disqualifications that may prevent hire of the Morgan.

The Morgan shall be driven only by the Hirer or other permitted drivers who have completed and signed the Braes Lodge Morgan Hire Proposal Form and who have presented the requested ID at time of hire.

Cancellation Conditions

Cancellation by you of a Morgan Self Drive Hire must be in writing. The effective date of cancellation must be given on your written notification. Our charges for cancellation are detailed below - number of days before hire start date that notification is received and cancellation charge (percentage of the full Morgan Self Drive Hire cost): 0 to 29 days - 90%

Braes Lodge reserve the right to cancel a hire booking at or before the hire period commences should the weather conditions in our sole opinion present a risk to your safety and or the safe keeping of the Morgan car. Under these circumstances the Hirer will be offered a full refund of the Morgan Self Drive Hire monies.

The hire agreement is made on the understanding that the Morgan will be available to you on the date agreed. Should this not be possible, through circumstances beyond our control, a full refund of monies for the Morgan hire will be provided. We will make every effort to inform you if the Morgan will not be available before you arrive at Braes Lodge.

Law

These Terms and Conditions and the Morgan Self Drive Hire Agreement to which they apply are governed by Scottish Law.
